What this guy loosely describes has been tried before and it didn't work out too well for the people that weren't in a position to 'negotiate' a contract with others.
As I see it this guy is attempting to make a case for everyone embracing a form of Anarcho-Capitalism.
Much as it would be fantastic that everyone would "contract" with each other in only a beneficial manner to all parties concerned, the reality of human nature is completely different.
Until we as a species have rehabilitated our selfish and ultimately destructive behaviour against others, some form of regulatory system will presumably be required.
